On this page we will provide you with all the relevant information regarding the Terms and Conditions of Use (hereinafter also "Terms") of our Platform and the operation of our Services.

These Terms and Conditions are the rules governing the use of the Superevisor platform (hereinafter also "Superevisor" or "Platform").

By using our Services (by Services we mean all of the features made available within the Platform) and our features you will accept these Terms and Conditions. For this reason we invite you to read it carefully. If you do not agree with the content of the Terms, please do not continue to use the Platform.

1.  Who we are

Superevisor is a Platform, accessible at www.superevisor.com, developed by Superevisor S.r.l. (VAT  and tax code 02985820345), with registered office in viale delle Esposizioni 106 - 43122, Parma (PR) (hereinafter also the "Holder").

Superevisor is an innovative online review platform dedicated to electric, green and sustainable mobility, which can be enjoyed through the browser at www.superevisor.com or through the web Apps downloadable through the App Store and Google Play.

2. Definitions

The terms referred to in this Article, when used in capital letters, shall have the following meanings:

Account: is the profile created by the User within the application/ Platform, in the manner indicated therein, through which it will be possible to enjoy multiple features;

App: is the Superevisor application, downloadable from Google Play and App Store platforms;

Content: content means the logos, distinctive signs, images, graphical interfaces and audio and video files and texts that are present on the Platform and on the App;

Device: with this term we indicate the device through which you use our App;

Premium Page: indicates the specific pages/showcases, made available by the Holder within the Platform where it is possible to show contents related to its products and activities;

Platform (or Superevisor): indicates the Superevisor portal (www.superevisor.com), unless otherwise specified, the term refers to both the web version and the version available through the App;

Services: indicates the set of features made available through the Platform and the App;

User: generally indicates the type of User, both Standard and Pro;

Pro User: indicates the professional users, in possession of particular skills in green mobility and sustainable means of transport, that activates a Pro Account on the Platform (web or App);

Standard User: indicates the entity that activates a Standard Account on the Platform and uses the Services;

Visitor: indicates who interacts with the Platform, even without activating an Account.

3.  User Profiles

Some features of the Platform are accessible to everyone, even without the need to create an Account. To be able to fully interact with the Platform (e.g. by leaving reviews and comments), you need to create a Personal Account.

The use of the Platform and the Services is reserved for adult users.

The Account that is activated by the User is strictly personal and cannot be transferred, even temporarily, to third parties. You are responsible for the safekeeping of your login credentials as well as the activities you perform through your Account and, therefore, if you notice or suspect unauthorized access to your Personal Account, you are advised to promptly report it to info@superevisor.com.

3.1. Standard User Account

Within the Platform, in order to gain access to a greater number of Services and in order to write and leave your review, you can proceed to the creation of a User Account. The creation and use of the Standard User Account is free of charge.

3.2. Pro user

Within the Platform, professional users of electric and green mobility - subject to verification by the Holder of the possession of the necessary requirements and skills - have the opportunity to register a Pro Account. Through the Pro Account, the User has the opportunity to respond to the reviews left by other Users, as well as the possibility that their reviews and comments are displayed with a different layout suitable to qualify them as Pro Users.

3.2.1. Requirements to become a Pro User

The Holder reserves the right to grant or deny the status of Pro User in the absence of the necessary experience and competence requirements. The possession of the requirements, as well as the verification of their persistence, is assessed at the sole discretion of the Holder.

Upon registration, the person requesting to become a Pro User must send, in the manner indicated on the Platform, a short bio describing their skills and experiences in the field of electric mobility.

4. Account management

4.1. Registration

The account registration, both for Standard Users and Pro Users, is made within the Platform, by entering (i) your username, (ii) your email address and (iii) a password. After the creation of the Account, within the User Area, you can complete your profile by entering - as regards Standard Users - the name, surname, nickname, city, a short bio and a personal image.

Pro Users, in addition to the information mentioned above, may enter additional information, including, for example, those relating to the vehicle/ means of transport owned, a link to their website, a video presentation (in mp4 format) a photo gallery and references to their profiles created on the Social Networks (e.g. Facebook, Instagram, Linkedin, Youtube).

The User, when registering, must provide accurate, up-to-date and correct information and undertakes to keep them constantly updated.

The User, in the Registration and management of his Account, undertakes to comply with the provisions of the following art. 8 (Responsible Use).

4.2. Suspension

The User undertakes to use the Platform and the Services in a lawful, correct and respectful manner of other Users, in accordance with the provisions of these Terms. Any non-compliant use will be assessed by the Holder at its sole discretion and may be considered as a violation of these Terms. In the event of a breach, we reserve the right to deny access to, suspend or delete your Account without notice.

4.3. Cancellation of the Account by the User

The User can, at any time, request the cancellation of their Account by sending an email to info@superevisor.com.

The request of cancellation by a Pro User does not give rise to any right to reimbursement of payments made. It is without prejudice to the right of withdrawal referred to in art. 52 and ss. of Legislative Decree no. 6 September 2005, n. 206 s.m.i.

5. Services

5.1. Standard Pages

Through the function "Insert a Product", Users have the possibility to create showcase pages related to products or services. Within the Standard Pages it will be possible to insert images and basic information. The creation of a Standard Page is free but cannot be managed or administered by the User who created it and does not allow you to respond to reviews and comments.

5.2. Premium pages

The Premium Page Service allows the owner of a specific Service/Brand/Activity, to register their own page-showcase within the Platform. Through the Premium Page, the owner of the same can show its products and services, comment on the reviews of users, respond to comments and insert links to their websites.

To register a Premium Page, the applicant must demonstrate ownership of the activity that is intended to be registered. To do this, you will be required to send a company bill or a bill related to a user (e.g. internet connection, electricity supply, etc.) that attests the ownership of the activity in question.

5.3. Premium Multiple Pages

Superevisor also provides companies with customized solutions with the aim of optimizing the management of more products. For details info@superevisor.com.

5.4. Write a Review

Through the function "Write a review" Users have the possibility to review the products on the Platform.

Superevisor reserves the right not to proceed with the publication of a Review that, in its sole discretion, may violate these Terms or violate the rights of other Users or third parties.

6.  Intellectual property rights

All intellectual property rights to the Services and Content available on the Platform are of property of Superevisor S.r.l. or its licensed dealers. Unless otherwise stated, therefore, the Services and Content of the Platform are protected by copyright, trademark or other intellectual and/or industrial property rights. The User is authorized to use the aforementioned Services and Content for personal use only with the express prohibition to reproduce, copy, publish, or commercially exploit such Services and Content. It is also prohibited to remove, obscure or alter any trademarks, logos and legal notices displayed in the Services and Content.

7. User-generated content

You grant Superevisor a license (including intellectual property rights) to materials, profile information (including your profile avatar/image), reviews, comments, and other types of communication that you post on the Platform (hereinafter "User-generated Content" or "UGC"). This license is to be understood as non-exclusive, indefinite and not revocable except in the event that there is a risk of serious damage to the image and/ or decoration of the User. The Content generated by the User may be used for the purpose of dissemination on online communication channels (e.g. Social Networks) as well as for any subsequent publication in the press, distribution and broadcasting through all means of communication to the public.

Users undertake to publish on the Platform only content that they own or for which they have the relevant rights of use and licenses, refraining from the publication of materials that may infringe intellectual and industrial property rights and any other rights of third parties. To this end, Users undertake to keep Superevisor harmless and indemnified from any prejudice, damage and consequential, direct and indirect that the same should incur as a result of the publication on the Platform of a UGC by the Users.

Superevisor, in any case, before proceeding to the publication on the Platform of a Comment or a Review, or to the insertion of a Product sent by the Users, may make a preliminary verification about the correctness of the text content. Supervevisor reserves the right, at its sole discretion, not to publish and/or remove any Content that conflicts with these Terms or that may violate the rights of other Users or third parties.

By way of example, Superevisor recalls that Content that:

infringes intellectual property rights and any other industrial property rights;

incite violence, discrimination, racism or intolerance;

violates the right to confidentiality of other Users or third parties;

may constitute and/or encourage boycott campaigns against products or services;

disseminate third parties or other Users;

have a vulgar or obscene content.

8. Responsible use

By adhering to these Terms, the User expressly undertakes to comply with the provisions therein and not to violate, in the use of the Platform and in the use of its Services and contents, intellectual or industrial property rights or other exclusive rights of Superevisor or third parties.

In any case, Superevisor shall not be liable in any way for any damage arising to third parties as a result of improper use of the Platform and/or in violation of these Terms by the User.

Therefore, the User hereby undertakes to keep Superevisor harmless and indemnified from any consequences arising from the incorrect use of the Platform or its Services and contents.

Each User may report any violations of these Terms and/or other published content by writing to info@superevisor.com.

In addition, the User undertakes to:

do not use the Services and Content for commercial purposes other than those explicitly permitted in these Terms and Conditions;

do not access, reproduce, distribute, transmit, display, sell, license, copy or otherwise exploit any Service or Content, other than as provided in these Terms. To this end, by way of example, the Services and Content include: information and images contained in Users' profiles, images, audio and video files, logos, texts and scripts, and any executable program on the Platform;

not perform deep linking activities of the Platform for any purpose, in the absence of prior written consent of Superevisor;

not framing, mirroring, or any other technique of incorporation of any Service, Content, or part thereof, without the express consent of Superevisor;

not download the Content and Services on the Platform, unless this is explicitly made available by Superevisor;

do not attempt to modify, adapt, translate, decompile, disassemble or decode or circumvent the software on the Platform.

9. Methods of payment

The Platform Services can be purchased through the Paypal service.

If the User decides to purchase a Service, he will be redirected directly to the website www.paypal.it where he can make payment in the manner provided by Paypal. The data entered on the Paypal website will be processed directly and exclusively by Paypal without being communicated or shared with Superevisor.

The Terms of use of the Paypal service are available at: www.paypal.com/it/webapps/mpp/ua/useragreement-full#013.

Users are aware and accept that Paypal is a third-party platform, over which Superevisor has no control or responsibility. For any complaints, the customer must contact Paypal directly.

10. Processing of personal data

We pay the utmost attention to the confidentiality, security and protection of the personal data we collect. As Data Controller, Superevisor undertakes to process the personal data of Users in accordance with the European and national legislation in force (Reg. EU 2016/679 GDPR and D.lgs. 196/2003 s.m.i.), as specified in the Privacy Policy, which is an integral and substantial part of these "Terms and Conditions of Use".

11. Warranties and limitations of liability

Superevisor is committed to maintaining and managing the Platform, using the best experience it has to ensure its efficiency. In this regard, Superevisor shall not be held liable in any way for any damage including, but not limited to, indirect, consequential, special, incidental damages, for any damage and/or anomalies that may occur and that are beyond the technical control of Superevisor, such as, for example, malfunctions in the management of telematic networks or malfunctions due to defects in the means necessary for access to the Platform, or misuse of the same. Furthermore, Superevisor shall not be liable for any interruption of services and contents resulting from force majeure, including, but not limited to, sabotage, fires, floods, earthquakes, strikes, faulty operation of services and content resulting from incorrect operation of telephone, electricity and networks worldwide and/ or national for failures, overloads or interruptions not attributable to Superevisor.

From time to time, it may also be necessary on our part to proceed with updates and implementations of our Platform, in such cases, access to the Platform and Services may be limited or excluded to allow us to implement changes. If this happens, you will be notified via a message within the Platform. In any case, Superevisor shall not be held in any way liable, directly or indirectly, for any damage related to such suspension of the service.

Some services provided by Superevisor contain links to external sites/apps/platforms. Superevisor shall not be held liable, directly or indirectly, for any damage related to the use of such sites/apps/platforms.

12. Assignment

Superevisor may assign all or part of the Platform, the Services and the rights under these Terms, including through licensing agreements. You may not assign these Terms, in whole or in part, transfer to third parties or sublicense your rights under these Terms.

13. Publication, amendment and validity of time limits

These Terms are valid and effective from the date of publication.

We reserve the right to make changes to these Terms at any time, even without notice. In case of changes to the Terms, the User will receive a notice via email to the address provided at the time of registration and/ or through a special popup on the Platform. The rights acquired by users who have purchased the premium version are not affected.

If you do not agree with the changes made, you may, at any time, proceed to the cancellation of your Account as described in Art. 4.3.

14.  Other provisions

The relationship between Superevisor and the User is governed by Italian law, according to which these Terms will be interpreted and regulated.

Any disputes arising in connection with these Terms, including those relating to validity, effect, interpretation, execution and resolution, shall be the exclusive competence of the Court of Parma.

Superevisor reserves the right to modify, update and/or suspend - periodically - certain Services and functionalities of the Platform. You understand and agree that Superevisor has no obligation to maintain or maintain the Services and features, except as required by applicable law and without prejudice to the rights acquired by Pro Users and owners of Premium Pages.

CLAUSES TO BE SPECIFICALLY APPROVED

The User under and for the effects of art. 1341 and 1342 of the Civil Code, declares to have read carefully and expressly approved the following clauses: Art. 4 (Account management); Art. 7 (User-generated content); Art. 11 (Warranties and limitations of liability); Art. 14 (Miscellanea).
